More Info On My Service For Senior Managers

I have been offered a settlement agreement, and am told my employer will pay for legal advice. Can you help?

Yes, I regularly advise on settlement agreements.

How does the settlement advice process work?

  • I ask you to provide me with one copy of your ID, and and address proof (a current driving licence, or a utility bill in the last 3 months) by email. I ask you to keep these documents to hand, when we have our advice session.
  • At the advice session (conducted via Microsoft Teams), after I have verified your documents – I first spend time understanding the context of your employment, and the situation that had led to the settlement agreement being offered.
  • I then advise you on your employment rights / potential claims, and give you a sense of what compensation that might derive. I then advise you on the terms of the settlement agreement.
  • If you wish to negotiate the agreement with your employer, I can provide that as an add-on service charged to you.

What is your fee for settlement agreements?

My minimum fee for advice on a settlement agrement is £500 + VAT.

My employer is only willing to bear £350 + VAT. Could I still use you?

Yes. If an employer doesn’t propose to match my minimum fee, we have two options. With your consent, I can (at no cost) write to your employer to ask if they would match our fee. Failing that or in the alternative, we can arrange to bill you separately for the difference.  

What happens if the compensation offered by employer in settlement agreement is insufficient?

There are two options: One, you can instruct us to negotiate the agreement. This will be at an extra charge to you between £250 and £400 + VAT for every round of correspondence. One round of correspondence would include: considering the best angle to seek additional sums from your employer, issuing them a letter / email, following their substantive response, advising you on potential next steps. The second option is to bring a claim in the employment tribunal. This is again something I can do or can arrange to be done for you.

Should I engage in obtaining settlement advice, if I am going to bring a claim against my ex-employer?

Its normal for ex-employees to want to bring a claim against their employer, especially when they consider they have been ill-treated. However, in my experience, with time such feelings start diminishing and the wait for employment tribunals and the various actions and costs that flow from it start feeling more cumbersome. Settlement advice from a seasoned employment litigator is always a useful starting point. If you choose to take our settlement advice and then litigate, whilst you will be bearing our agreed fee for settlement advice – this is not entirely wasted costs, as I would have learnt about you and your case. This is essential information for litigation as well.
